Trademarks
General Information
- Classification - 10th edition — single class filing. Class 33, alcoholic goods in class 32, and pork meat in class 29 are not acceptable for registration
- Search - Possible for word and device marks
- Examination - Both formality and substantive
- Opposition Period - 60 days from publication date
- Extension of time - Not possible for filing oppositions, counter oppositions, and responding to office actions
- Term of protection - 10 years from filing date renewable indefinitely
- Use - Non-use of the mark for a period of 5 consecutive years exposes to mark to cancellation by any interested parties
Filing Requirements
- Power of Attorney duly legalized by the Kuwaiti Consulate.
- In case of claiming priority, a certified copy of the corresponding home or foreign application.
Renewal
- Power of Attorney duly legalized by the Kuwaiti Consulate.
- The original Registration Certificate for endorsement.
Assignment
- A Power of Attorney executed by the assignee and duly legalized by the Kuwaiti Consulate.
- A deed of assignment signed by both parties and legalized by the Kuwaiti Consulate.
- The original Registration Certificate for endorsement purposes.
Merger
- A Power of Attorney duly legalized by the Kuwaiti consulate
- A merger document duly legalized by the Kuwaiti Consulate.
- The original Registration Certificate for endorsement purposes.
Change of Name or Address
- A Power of Attorney executed in the new name and/or address and duly legalized by the Kuwaiti Consulate.
- A certificate of change of name and/or address duly legalized by the Kuwaiti consulate.
- The original Registration Certificate for endorsement purposes.
Patents
Filing Requirements
- A Power of Attorney, duly legalized up to the Kuwaiti Consulate.
- All PCT documents.
- The English specification, claims, and drawings, if any, along with the Arabic translation thereof (it will be prepared at our end).
Industrial designs
General Information
- Term of protection - 10 years from filing date
- Examination - Formality, novelty, and industrial applicability
- Application with multiple figures - Acceptable for up to 50 figures
- Renewal - Allowed for one 5 year term
Filing Requirements
- Power of Attorney duly legalized by the Kuwaiti Consulate.
- Extract from the Commercial Register, Articles of Incorporation or Memorandum of Association, if the applicant is a company, duly legalized by the Kuwaiti Consulate.
- Title and brief description of the design, together with two copies of its drawings.
