General Information
  • Classification - 11th edition — multiclass application
  • Search - Possible for word and device marks
  • Examination - On formal and absolute grounds
  • Opposition period - 2 months from publication date
  • Extension of time - Not possible for filing oppositions, counter oppositions, and responding to office actions
  • Term of protection - 10 years from filing date and renewable for like periods
  • Use - Mark is vulnerable to cancellation action by interested parties if there is no effective use of the mark for a period of 5 consecutive years.

Filing Requirements
  • Power of Attorney simply signed and stamped indicating the name and title of the signatory.
  • In case of claiming priority, a certified copy of the corresponding home or foreign application.
  • The musical composition (notes) for sound marks and explanatory legend regarding the essence for smell marks.

Renewal
  • Power of Attorney simply signed and stamped indicating the name and title of the signatory.

Assignment
  • Power of Attorney from the Assignee simply signed and stamped indicating the name and title of the signatory.
  • Deed of Assignment signed by both parties.

Merger
  • Power of Attorney, from the entity surviving the merger, simply signed and stamped indicating the name and title of the signatory.
  • Certificate of Merger duly legalized by Moroccan Consulate

License
  • Power of Attorney from the licensee.
  • Copy of the License Agreement duly legalized by Moroccan Consulate

Change of Name or Address
  • Power of Attorney in the new name and/or address simply signed and stamped indicating the name and title of the signatory.
  • Extract from the Commercial Register.

Withdrawal
  • Special Power of Attorney stating the withdrawal simply signed and stamped indicating the name and title of the signatory.

Registration at Customs Department
  • Power of Attorney duly legalized by the Moroccan Consulate.
  • Copy of the applicant’s Certificate of Incorporation or Commercial Register document.
  • Certified copy of Certificate of Registration of each relevant trademark. (Must be issued within three months before the date of execution)
  • Undertaking letter in respect of the liability against counterfeit products, simply signed. (Must be issued within three months before the date of execution)
  • Declaration letter, printed on the applicant’s letterhead, stating the capacity of the signatory and the power entrusted thereto, duly signed and notarized. (Must be submitted within three months from the date of execution

Patents

General Information
  • Search - Yes through the published ones only by title, patentee name, inventors, and priority/PCT number/date
  • Examination - Both formality and substantive
  • Publication - Applications are published upon grant
  • Opposition - There are no provisions
  • Annuities - Paid after grant and payable on the anniversary of the international filing date. A grace period of 6 months for late payment of annuities with an extra charge
  • Term of Protection - 20 years from the international filing date

Filing Requirements
  • Power of Attorney from the applicant simply signed and stamped indicating the name and title of the signatory.
  • Two copies of the specification, claims, abstract and formal drawings.
  • Certified priority document.

Assignment
  • Power of Attorney from the Assignee.
  • Deed of Assignment duly legalized by Moroccan Consulate

  • A Power of Attorney from the entity surviving the merger, simply signed and stamped indicating the name and title of the signatory.

  • Power of Attorney from the licensee simply signed and stamped indicating the name and title of the signatory.
  • License agreement duly legalized by Moroccan Consulate

Change of Name or Address
  • Power of Attorney in the new name and/or address, simply signed and stamped indicating the name and title of the signatory.
  • Extract from the Commercial Register

Industrial designs

General Information
  • Term of protection - 5 years from filing date
  • Examination - Formality only
  • Application with multiple figures - Acceptable for up to 50 figures
  • Renewal - Allowed for two consecutive of 5 years each

Filing Requirements
  • Power of Attorney from the applicant simply signed and stamped indicating the name and title of the signatory.
  • Three representation of the design.
  • Short description of the design.
  • Priority document, if priority is claimed.

Assignment
  • Power of Attorney from the Assignee simply signed and stamped indicating the name and title of the signatory.
  • Deed of Assignment simply signed and stamped notarized.

Merger
  • Power of Attorney from the entity surviving the merger simply signed and stamped indicating the name and title of the signatory.
  • Notarized deed of Merger signed and stamped.
  • Certified copy of certificate of merger duly legalized by Moroccan Consulate

Change of Name or Address
  • Power of Attorney in the new name and/or address simply signed and stamped indicating the name and title of the signatory.
  • Extract from the Commercial Register.
