General Information
  • Classification - 8th edition — single class application. Class 33, alcoholic goods in class 32, and pork meat in class 29 cannot be registered
  • Search - Possible for word and device marks
  • Examination - Formality, absolute, and relative grounds
  • Opposition period - 90 days from publication date
  • Extension of time - Not possible for filing oppositions, counter oppositions, and responding to office actions
  • Term of protection - 10 years from filing date and renewable for like periods
  • Use - Mark is vulnerable to cancellation action by interested parties if there is no bona fide use of the mark for a period of 5 consecutive years preceding the date of filing for cancellation

Filing Requirements
  • Power of Attorney, duly legalized by the Yemeni Consulate.
  • Extract from the entry of the applicant in the Commercial Register, or any equivalent document, duly legalized by the Yemeni Consulate.

Renewal
  • Power of attorney legalized by the Yemeni Consulate.
  • Photocopy of the registration certificate.

Assignment
  • Power of attorney signed by the assignee, legalized by the Yemeni Consulate.
  • Deed of assignment document legalized by the Yemeni Consulate.
  • Certified copy of the certificate of incorporation or an extract from the commercial register of the assignee with it Arabic or English translation.
  • Copy of the registration certificate or the last renewal certificate.

License
  • Power of attorney signed by the licensee, legalized by the Yemeni Consulate.
  • License agreement document with Arabic or English translation, legalized by the Yemeni Consulate.
  • Copy of the registration certificate or the last renewal certificate.

Change of Name or Address
  • Power of attorney under the new name or address, legalized by the Yemeni Consulate.
  • Certificate of incorporation or extract from the commercial register reflecting the change of name or address, legalized by the Yemeni Consulate with Arabic or English translation.
  • Copy of the registration certificate or the last renewal certificate.

Patents

General Information
  • Search - Both pending and granted patents can be searched by title, patentee name or priority data
  • Examination - Formality only
  • Publication - Published in the Official Gazette upon allowance
  • Opposition period - 90 days from publication
  • Annuities - Paid annually on the anniversary of the filing date, currently there is no additional charge for late payment of maintenance fees.
  • Term of protection - 20 years from the filing date

Filing Requirements
  • Power of Attorney, duly legalized by the Yemeni Consulate.
  • Deed of Assignment from the inventor(s), duly legalized by the Yemeni Consulate or a copy of the original Assignment as filed with the basic foreign application, duly legalized by the Yemeni Consulate.
  • An Extract from the Commercial Register or Articles of Association or Incorporation, if the applicant is a corporate body, duly legalized by the Yemeni Consulate.
  • In case of claiming priority, a certified copy of the corresponding home application duly Legalized by the Yemeni Consulate.

Assignment
  • Power of attorney signed by the assignee, legalized by the Yemeni Consulate.
  • Deed of assignment document legalized by the Yemeni Consulate.

Merger
  • Power of attorney legalized by the Yemeni Consulate.
  • Merger agreement document with Arabic or English translation, legalized by the Yemeni Consulate.

License
  • Power of attorney signed by the licensee, legalized by the Yemeni Consulate.
  • License agreement document with Arabic or English translation, legalized by the Yemeni Consulate.

Change of Name or Address
  • Power of attorney under the new name or address, legalized by the Yemeni Consulate.
  • Certificate of incorporation or extract from the commercial register reflecting the change of name or address, legalized by the Yemeni Consulate with Arabic or English translation.

Industrial designs

General Information
  • Term of protection - 10 years from filing date
  • Examination - Formality and content
  • Application with multiple figures - Possible for up to 3 figures
  • Renewal - Not possible

Filing Requirements
  • Power of attorney legalized by the Yemeni Consulate.
  • Ten sets of specimens or representations of the design.
  • Description of the design pointing out its novel aspects.
  • Certified copy of the certificate of incorporation or an extract from the commercial register with its Arabic or English translation.
  • Certified copy of the priority document if claimed

Assignment
  • Power of attorney signed by the assignee, legalized by the Yemeni Consulate.
  • Deed of assignment document legalized by the Yemeni Consulate.

  • Power of attorney legalized by the Yemeni Consulate.
  • Merger agreement document with Arabic or English translation, legalized by the Yemeni Consulate.
