Trademarks
General Information
- Classification - 8th edition — single class application. Class 33, alcoholic goods in class 32, pork meat in class 29, and Christmas trees and related products in class 28 cannot be registered.
- Search - Possible for word and device marks.
- Examination - Formality and substantive.
- Opposition period - 3 months from publication date.
- Extension of time - Not possible for filing oppositions, counter oppositions, and responding to office actions.
- Term of protection - years from filing date and renewable for like periods.
- Use - Mark is vulnerable to cancellation action by interested parties if there is no effective use of the mark for a period of 5 consecutive years.
Filing Requirements
- Power of Attorney legalized by the Libyan Consulate.
- Certified copy of the Extract from the Commercial Register or Articles of Incorporation, legalized by the Libyan Consulate along with the Arabic translation of the same.
- In case of claiming priority, a certified copy of the priority document should be submitted upon filing.
Renewal
- Power of Attorney duly legalized by the Libyan Consulate.
- Copy of the Registration Certificate.
Assignment
- Power of Attorney duly legalized by the Libyan Consulate.
- Deed of Assignment duly legalized by the Libyan Consulate. An Arabic Translation of the document is mandatory.
- Certified copy of the Extract from the Commercial Register or Articles of Incorporation of the applicant also legalized by the Libyan Consulate. An Arabic translation is mandatory.
License
- Power of Attorney duly legalized by the Libyan Consulate.
- License agreement duly legalized by the Libyan Consulate. Arabic translation of the document is mandatory.
- Extract from the Commercial Register or Articles of Incorporation of the applicant duly legalized by the Libyan Consulate. Arabic translation is mandatory
Change of Name or Address
- Power of Attorney, duly legalized by the Libyan Consulate.
- Certificate of Change of Name and/or Address duly legalized by the Libyan Consulate. Arabic translation of the document is mandatory.
Patents
General Information
- Search - Currently not available
- Examination - Formality only
- Publication - Applications are not published prior to 18 months from the filing date or the earliest priority
- Opposition period - 60 days from publication date
- Annuities - Paid annually on the anniversary of the Libyan filing date and payable after grant. A grace period of 6 months is allowed for late payment without an extra charge
- Term of protection - 15 years from the Libyan filing date.

- A Certified Copy of Priority document, in case of claiming priority. Arabic translation is mandatory.
- For PCT application, copy of the first two pages of the PCT Application as published. Arabic Translation is mandatory.
- Specification, claims, abstract in Word format and formal drawings, if any, in English and Arabic.
Assignment
- Power of Attorney duly legalized by the Libyan Consulate.
- Deed of Assignment signed by both the assignee and the assignor. Arabic translation is mandatory.
- Extract from the Commercial Register or Articles of Incorporation of the assignee duly legalized by the Libyan Consulate. Arabic translation is mandatory.
Change of Name or Address
- Power of Attorney duly legalized by the Libyan Consulate.
- Certificate of Change of Name and/or Address duly legalized by the Libyan Consulate. Arabic translation of the document is mandatory.
