Trademarks
General Information
- Classification - 10th edition – single class application
- Search - Possible for word and device marks
- Examination - Formality and substantive
- Opposition period - 3 months from publication date
- Extension of time - Possible for filing oppositions, counter oppositions, and responding to office actions
- Term of protection - 7 years from filing date and renewable for periods of 14 years each
- Use - Mark is vulnerable to cancellation action by interested parties if there is no bona fide use of the mark for a period of 2 years preceding date of filing for cancellation
Filing Requirements
- Power of Attorney legalized by the Palestinian Consulate.
Renewal
- Power of Attorney legalized by the Palestinian Consulate.
Assignment
- Power of Attorney legalized by the Palestinian Consulate.
- Deed of Assignment signed by both Assignor and Assignee, duly legalized by the Palestinian Consulate.
License
- Power of Attorney by the licensee, simply signed and stamped.
- License agreement executed and sealed by both parties together with its French or Arabic translation.
Change of Name or Address
- Power of Attorney, in the new name and/or address, duly legalized by the Palestinian Consulate
- Certificate of Change of Name duly legalized by the Palestinian Consulate
Patents
General Information
- Search - May be done by subject matter, patentee name, title and priority numbers
- Examination - Formality and patentability
- Publication - Published in the Industrial Property Gazette
- Opposition period - 2 months from publication
- Annuities - Paid annually on the anniversary of the filing date and payable before the expiration of the 4th, 8th, and 12th year anniversaries from filing date. A grace period of 2 months is allowed for late payment with an extra charge
- Term of protection - Protection term for patent of origin
Filing Requirements
- Power of Attorney, legalized by the Palestinian Consulate.
- Certificate of Incorporation or Extract of commercial Register
- 3 copies of the specifications in English with Arabic translation.
- 3 sets of formal drawings.
- Statement under oath signed by the inventor.
Renewal
- Power of Attorney legalized by the Palestinian Consulate.
Assignment
- Power of Attorney legalized by the Palestinian Consulate.
- Deed of Assignment signed by both Assignor and Assignee, duly legalized by the Palestinian Consulate.
Change of Name or Address
- Power of Attorney, simply signed and stamped.
- Certificate proving the change of name or an extract from the Commercial Register translated into French or Arabic.
Industrial designs
General Information
- Term of protection - 5 years from filing date
- Examination - Formality only
- Application with multiple figures - Unacceptable
- Renewal - Allowed for two consecutive terms of five years each
Filing Requirements
- Power of Attorney, duly legalized by the Palestinian Consulate.
- Extract from Commercial Register or Articles of Incorporation, if the applicant is a corporate body, also legalized by the Palestinian Consulate. (separate document for each territory)
- Three representations of the design. (Separate prints for each territory).
- Representations of each different side of the design, if the design is three dimensional.
- Brief description of the design.
- The class (es) in which the design is to be registered
Renewal
- Power of Attorney duly legalized by the Palestinian Consulate.
Assignment
- Power of Attorney legalized by the Palestinian Consulate.
- Deed of Assignment signed by both Assignor and Assignee duly legalized by the Palestinian Consulate.
Change of Name or Address
- Power of Attorney in the new name and/or address, duly legalized by the Palestinian Consulate.
- Certificate of Change of Name duly legalized by the Palestinian Consulate.
