Trademarks

General Information
  • Classification - 11th edition — Single class application
  • Search - Possible for word and device marks
  • Examination - Formality and substantive
  • Opposition period - 90 days from publication date
  • Extension of time - Not possible for filing oppositions, counter oppositions, and responding to office actions
  • Term of protection - 10 years from filing date and renewable for indefinitely
  • Use - Mark is vulnerable to cancellation action by interested parties if there is no bona fide use of the mark for a period of 3 consecutive years preceding the date of filing for cancellation

Filing Requirements
  • Power of Attorney, duly legalized by the Syrian Consulate
  • Copy of the home or foreign registration of the trademark. (The Registrar may request a certified copy thereof later).
  • Extract of the Commercial Register or a copy of the Applicant’s passport in case the Applicant is an individual.
  • Compulsory Trademark -
  • Power of Attorney duly legalized by the Syrian Consulate.
  • Copy of the home or foreign registration of the trademark (The Registrar may request a certified copy thereof later).
  • Legalized certificate from the Ministry of Health, Chamber of Commerce or any other competent authority as to the true origin of the products upon which the trademark(s) is (are) applied, one certificate can include all trademarks the applicant intends to file in future.

Patents

General Information
  • Search - May be done by title, applicant, priority or PCT number
  • Examination - Formality and substantive
  • Publication - Published in the Official Gazette after substantive examination and pre-grant
  • Opposition period - 6 months from publication in the Official Gazette
  • Annuities - Annuities must be paid annually from the international filing date, even prior to patent granting. A grace period of 6 months is allowed for late payment with an extra charge
  • Term of protection - 20 years from the filing date (15 years if patent was granted prior to 2012)

Filing Requirements
  • Power of Attorney duly legalized by the Syrian Consulate.
  • A copy of the Company’s Commercial Register, or a copy of the Applicant’s passport in case the Applicant is an individual.
  • A Certified copy of the corresponding basic or foreign application also legalized by the Syrian Consulate.
  • Deed of Assignment from the inventor(s) duly legalized by the Syrian Consulate.
  • Copy of the PCT international application with the Arabic translation.
  • Copy of the PCT publication.
  • Copy of the search report with the Arabic translation.
  • Written opinion.
  • Copy of priority document with the Arabic translation.
  • Specifications, claims and abstract of the invention in English with the Arabic translation.

Industrial designs

General Information
  • Term of protection - 5 years from filing date
  • Examination - Formality and novelty
  • Renewal - Allowed for two consecutive terms of 5 years each

Filing Requirements
  • Power of Attorney, duly legalized by the Syrian Consulate.
  • Copy of the design home or foreign registration.
  • Six photographs of each design in all dimensions. (The Registrar may request a physical sample of the design later).
